Judge Says Florida Teen Unfit for Trial
WEST PALM BEACH, Fla. (AP) — A teenager accused of raping an 8-year-girl and leaving her for dead in an abandoned landfill has been declared mentally incompetent and unfit to stand trial.
Palm Beach County Circuit Judge Edward Garrison ordered Milagro Cunningham, 18, committed to a treatment facility of the Department of Children and Families. The order, issued Thursday, requires the agency to report on Cunningham's condition within six months.
Cunningham, a native of the Bahamas, was charged as an adult with attempted first-degree murder, sexual battery, kidnapping and other counts. He had been held without bail since his arrest in May 2005, when he was 17.
Police discovered the girl under chunks of concrete at a landfill May 22, 2005, about seven hours after she was reported missing from her godmother's home. She identified Cunningham as her attacker.
Authorities said the teen confessed after initially telling police that five men in a station wagon took her.
Cunningham's public defender argued last year that the teen comprehended and communicated "within the range of a 7- to 9-year-old child," the Palm Beach Post reported on its Web site Monday. Two of three mental health experts appointed to evaluate him concluded that he was incompetent, according to the newspaper.
The after-hours recording at the Palm Beach County Public Defenders office would not accept an incoming message Monday night.
Officials have said Cunningham was in the country illegally but escaped the notice of immigration authorities after three burglary arrests in 2004 because his cases were handled in the juvenile justice system.

wtf? he should be killed! that is so horrible! mentally incompetent my arse. 7-9 year olds dont go around raping people, and if they did, they damn well deserve to be killed too!!! i don't care how incompetent he is. that is NO excuse for rape. there is no excuse. period.

I'm sorry but he understood enough to want sex..This kid need to spend life in jail or worse....

From my book 7 and 9 yr olds don't know what rape is let alone do it
it was a teenager that raped an 8 yr old....and I have heard one too many stories where teenage boys have raped lil baby 7 ry - 9 yr old girls
that fcuks up their life (meaning the lil baby girls life) and what does this sick teenager get??
Slap on the wrist?? like most do
I won a debate once on UM...I was for teenagers from 16 onwards..to do adult time...cuz my theory was --- If you are big enough to commit adult CRIME...then you can do adult TIME

You know i'm sorry, But i have two teenage girls and this guy need's to but to death..If he had the sense to know what rape was then he knew it was wrong....If that was my daughter..I'd be the one going to jail..He just be going to the morgue.....

OH! I misunderstood a little 
He might have the mind of a 9 year old....but his body is still that of a young adult (17).
